1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and me, the owner and operator of hardest.app (“I”, “my”, “me”), concerning your access to and use of the https://hardest.app website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).
By accessing the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2. Intellectual Property Rights
The Site is my proprietary property. All source code, databases, functionality, software, website designs, audio, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by me or licensed to me, and are protected by copyright and trademark laws.
The Content is provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without my express prior written permission.
3. License for Digital Downloads
I grant you a limited, non-exclusive, non-transferable, revocable license to download and use the provided audio files (FLAC) and tracking sheets (Excel) (the “Digital Products”) solely for your personal, non-commercial use. You agree not to reproduce, distribute, or create derivative works from the Digital Products without my express consent.
4. User Representations
By using the Site, you represent and warrant that:
(1) you have the legal capacity and you agree to comply with these Terms and Conditions;
(2) you will not use the Site for any illegal or unauthorized purpose; and
(3) your use of the Site will not violate any applicable law or regulation.
5. Future Paid Subscriptions
I reserve the right to introduce paid subscriptions or other commercial services in the future. Should you choose to purchase any products or services, you will be required to agree to separate terms of sale that will be presented to you at that time.
6. Term and Termination
These Terms and Conditions shall remain in full force and effect while you use the Site. I reserve the right to, in my sole discretion and without notice or liability, deny access to and use of the Site to any person for any reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms and Conditions.
7. Governing Law
These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law principles.
8. Disclaimers and Limitation of Liability
The Site is provided on an as-is and as-available basis. You agree that your use of the Site and my services will be at your sole risk. I expressly disclaim all warranties, express or implied, in connection with the site and your use thereof.
